Hearing and Action Items from Public Hearing
A.
Hold a
public hearing and take action on a commercial replat, Hidden Lakes
Commercial, Section 2, Replat No. 1, being a replat of Lot 1 of the

Mark Linenschmidt, Senior Planner, presented for the City
of League City.
The replat is for the Hidden Lakes Commercial Section 2,
and located in the Hidden Lakes PUD, in South Shore on League City Parkway.
A map is shown illustrating the location of the replat.
The replat is located at the vacated HEB grocery store
and gas station.
The following timeline is given:

November
4, 2013 – Hidden Lakes Commercial, Section 2 plat submitted for DRC review.
·
February
17, 2014 – Planning & Zoning Commission approves the plat as a
Preliminary/Final plat.
·
March 10,
2014 – Hidden Lakes Commercial, Section 2 plat recorded with Galveston County.
·
March 11,
2014 – HEB Site Plan is approved by DRC.
·
July 29,
2014 – A revision revising the roadway layout is approved by DRC.
·
November
5, 2014 – HEB opens to the public.
·
April 27,
2015 – Replat submitted for review by the DRC.
·
August 3,
2015 – Planning and Zoning Commission is scheduled to hold a public hearing and
consider the replat.
Plat is 17.49 acres in size and is to include 0.1 acres
of unplatted portion of an adjoining property.
The plat would encompass the entire site driveway along
League City Parkway.
This was a public hearing in accordance with state law.
Mr. Linenschmidt was available for questioning and the applicant
was present.
Mr. Dugie – Does the applicant own the HEB and the small
unplatted portion?
Mr. Linenschmidt – Yes.
Mr. Dugie – Does this meet all City ordinances?
Mr. Linenschmidt – Yes. Utilities have already been
provided for the property because of the HEB. City staff verified this because
the waterline was extended to the other part of the driveway.
The Chair explained the following guidelines in conduct
of the hearing:
A statement of no longer than three minutes may be made
on items of general relevance.
There will be no yielding of time to another person.
State law prohibits any member of the planning and zoning
commission in making any statement or engaging in any dialogue without an appropriate
agenda item being posted, in accordance with the Texas Open Meetings Law.
Comments should be directed at the commission instead of
individual members.
Engaging in verbal attack, or comments intended to
insult, abuse, or slander any individual shall be cause for termination of time
privileges and expulsion from the meeting.
The public hearing was opened at 6:09 PM.
No one came forth to speak.
The public hearing was closed at 6:09 PM.
Mr. Wicker motioned to approve the replat.
Mr. Dugie seconded the motion.
The motion passed 3-0-0.
B.
Hold a
public hearing and take action on a commercial replat, Hobbs Road
Business Park, being a replat of part of Lot 31 in the Braskora Gardens
Subdivision, being approximately 9.56 acres generally located south of FM 518
(West Main Street) and west of Hobbs Road.
Matt Grooms, Planner, presented for the City of League
City.
The request is for a replat of approximately 9.56 acres,
located west of Hobbs Road, north of Sunset Court, east of Newport Boulevard
and South of FM 518.
The site is zoned general commercial and is surrounded by
other general commercial properties.
To the South, the property is zoned RMF-1.2 Residential
Multi-Family with a maximum density of 36 dwelling units per acre, which
transitions to RMF-7Residential Single Family with a minimum lot size of 7,000
square feet.
A map of the area is shown.
To the north is the Cornerstone Commercial Plaza and
Horizon Indoor Sports Center. To the west is the Brantley Commercial Park, to
the south is the Oaks of League City Apartment and section1 of the Newport
Subdivision, and east is Undeveloped General Commercial Property.
The proposed plat would subdivide two commercial lots
from Lot 31 of the Braskora Gardens Subdivision.
Access is given to the properties from Hobbs Road, which
is a 60 foot right-of-way.
It was confirmed, by the Engineering Department, that additional
right-of-way dedication is not required along Hobbs Road for the property, and
utilities are adequate for the site.
City Staff recommended approval of the plat because it
meets subdivision and development ordinances, as well as state law.
City Staff and the applicant were available for
questions.
Mr. Wicker – The advertisement for the public hearing
stated 9.56 acres, but if you add the two tracts they equal about 5 acres.
Mr. Grooms – That was an error.
The public hearing was opened at 6:14 PM.
No one came forth to speak.
The public hearing was closed at 6:14 PM.
Mr. Dugie – To the City Attorney, does the advertisement
of 9.56 acres stall us from making a vote on this?
Mr. Doan – We advertised for more acreage than it
actually covers.
Mr. Doan – The identification of the tract is correct?
Mr. Grooms – Yes.
Mr. Doan – Then it is okay; the City gave more than
enough notice.
Mr. Dugie motioned to approve the replat.
Mr. Wicker seconded the motion.
The motion passed 3-0-0.

Mr.
Linenschmidt presented for the City of League City.
The
item was tabled at the June 1, 2015 Commission meeting. Commission requested to
see a survey or a description of the property.
The
City now has the metes and bounds for the property. That metes and bounds was
required because the City had made several accountings for consideration of
right-of-way on Texas Avenue and Powers Street, as well as for maintenance
easements around the property associated with the drainage easement.
A
copy of the metes and bounds was provided.
City
Staff was available for questions.
Mr.
Wicker – Will the City have it surveyed before they sell it?
Mr.
Linenschmidt – It will not be surveyed because the metes and bounds go into the
records.
Mr.
Wicker – Are you saying a metes and bounds is the same as a survey?
Mr.
Linenschmidt – No.
Mr.
Wicker – The commission asked for a survey. Metes and bounds can be retrieved
from an old map.
Mr.
Linenschmidt – The recorded meeting minutes specified that the requirements
were a survey and/or some sort of description of the property. We can use
surveys or metes and bounds when we forward ordinances to City Council for
their consideration, which is also reviewed and approved by the City Attorney. On
June 9th, City Council did have an approval that declared this
property surplus and directed Staff to sell it.
Mr. Wicker motioned to remove Z15-11 from the table.
Mr. Dugie seconded the motion.
The motion passed 3-0-0.
Mr. Dugie – How many lots would this allow for?
Mr. Linenschmidt – Roughly four lots.
Mr. Dugie motioned to approve zone change Z15-11.
Mr. Wicker seconded the motion.
The motion passed 3-0-0.
