Mr. Hullman called the meeting to order at 6:07 p.m.

Mr. Owens made a motion to discuss agenda items IIIA. And
IIIB. prior to discussing agenda item IIA.
Mr. Turner seconded the motion.
The motion was adopted by a vote of 8-0-0.

Old Business
C. Hold a joint discussion with the Historic District
Commission regarding a proposed amendment to Section 125.81 of the Zoning
Ordinance which establishes the land use regulations for the Residential
Neighborhood Conservation Overlay District.
Tony Allender, Director of Planning & Research
provided an overview of the proposed amendments to Section 125.81 of the Zoning Ordinance which
establishes the land use regulations for the Residential Neighborhood
Conservation Overlay District.
A discussion was held.
Historic District Commissioner, Elizabeth Schroeder
asked about the special use permit procedures for developing an eating and
drinking establishment.
In response to Ms. Schroeder’s question Wes Morrison,
City Planner discussed five additional considerations for the RNC Overlay
District including requiring a special use permit for eating and drinking
establishments.
Mr. Morrison stated that Planning & Zoning
commissioners may address eating and drinking establishments in the following
ways:

Amend the use table to require
special use permits for eating and drinking establishments and remove the
limitation.
·
Require a special use permit and
keep the maximum size limitation.
·
Lower the square footage of eating
and drinking establishments in the district.
Mr. Allender suggested that the commission require a
special use permit without any limitations.
Historic District Commissioner, Marie Sesher asked if convenience
stores should be permitted in the RNC zoning district.
Mr. Morrison in response stated that this use is
currently permitted in the current RNC ordinance therefore staff did not remove
the use from the current use table.
Ms. Sesher stated that the Historic District
Commission would not receive notifications for special use permit applications that
have been submitted to the City.
Mr. Hullman in response stated that anyone lying
outside of the 500 foot notification buffer would not be affected by a special
use permit application if submitted.
Mr. Allender also stated that if the commissioners are
suggesting expanding the notification area to be greater than 500 feet then it
should be expanded throughout the city and not limited to the Historic
District.
Mr. Hullman further stated that the city’s
notification requirements are greater than the state requirements.
Mr. Hullman asked the commissioners if they preferred
square footage limitations or a special use permit.
The majority of the commissioners were in favor of
square footage limitations.
D.
Take action regarding a
proposed amendment to Section 125.81 of the Zoning Ordinance which establishes
the land use regulations for the Residential Neighborhood Conservation Overlay
District.
Mr. Hullman made a motion to approve the proposed amendment to Section 125.81 of the Zoning
Ordinance which establishes the land use regulations for the Residential
Neighborhood Conservation Overlay District subject
to the five additional considerations that were received by staff excluding the
special use permit requirements identified in item 4:
1.) Staff is aware that some
terms within the proposed RNC Draft will need to be defined. In keeping with
the current zoning ordinance format, all terms within the Zoning Ordinance are
defined in Article V. Staff has started compiling these terms and will be
bringing an amendment to the Planning & Zoning Commission and City Council
for adoption of additional definitions.
2.) With regards to Schedule
125.81.H: A note should be added that transparency requirement will apply to
the portion of the structure that is below the top plate of the roof line.
3.) Section 125.81.H(d)(2)
should be amended to say buildings that have a greater width along the front
façade and not “buildings that are larger than the average…”
4.) With regards to the use
table, in order to strike a compromise with residents and property owners,
staff is proposing to amend the use chart for “Eating and Drinking Establishments”
currently it’s proposed that these uses will be allowed by right with a
limitation of maximum 3,000 square feet. Staff has proposing to amend that to
allow with an approved Specific Use Permit. In addition, Food & Beverage
(Convenience Stores) uses should be limited to 1500 square feet. The
neighborhood has also expressed concern with multi-family uses above commercial
allowed by right, their request is that all multi-family uses require an
approved Specific Use Permit.
5.) Allow front porches to
encroach the front yard setback by 6 feet.
Mr. McKillip seconded the motion.
The motion was adopted by a vote of 6-2-1.
Mr. Hamilton and Mr. Landon were in opposition of the
motion.
Mr. Froeschner abstained from voting citing a conflict
of interest.

Mr. Hullman adjourned the meeting at 8:15 p.m.
